CONFERENCE “KIЕV ARBITRATION DAYS 2014: "THINK BIG"
Our MD Mr. Soteris Pittas attended as a member of the organizing Commitee and a key speaker, the Conference “KIЕV ARBITRATION DAYS 2014: Think Big!” held on 06-07 November 2014, in Kiev, Ukraine, under the auspices of Ukrainian Bar Association.
Mr. Pittas spoke in the third session of the Conference, titled “Waiver of a right to arbitrate under an international commercial arbitration agreement by resorting to litigation”. Other panelists included Mrs. Elke Umbeck, Partner at Heuking Kuhn Luer Wojtek - Germany, Mr. Nikolaus Pitkowitz, Partner at Graf Pitkowitz - Austria.
The topics discussed were:
• Procedural issues in M&A arbitration (repudiation, waiver of arbitration agreement, etc.)
• M&A pre-closing and post-closing disputes.
• Deceit, avoidance of contract and restitution.
In his speech, Mr. Soteris Pittas examines the circumstances, under which a party to an international commercial arbitration agreement, may be deemed to have waived his right to arbitrate a dispute, covered by an arbitral agreement, by resorting in litigation involving the dispute, including examination under the common law jurisdictions particularly England and Australia, examination amongst others of the term ‘waiver’ and principles governing issues of repudiation under English law, positive & negative obligations in the international arbitration agreements, approach of English courts to repudiatory breach in the arbitration agreements and legal effect of waiver.
The discussion was moderated by Mr. Markiyan Kliuchkovskyi, Partner at Egorov Puginsky Afanasiev & Partners, Ukraine.
The event was attended by partners and associate lawyers of international law firms as well as of Ukrainian and Russian law firms.
