In a recent case, handled by our office, a Cypriot court ordered a Cypriot administrator of the estate of a deceased foreign resident person (on the basis of a limited grant), to deposit security for costs, in favor of the defendants to a Civil action filed by the Administrator, in her aforesaid capacity.
The Court decided that the administrator of an estate of a deceased person, was suing in a representative, or a nominal capacity, for the interest of a third party, and as such he/she, is obliged to secure the legal costs of the defendants.
