In the very recent decision of Re Mosaica Investments Limited, Petition No. 573/2022 DC. Nicosia, Interim Decision dated 21.02.2023, in the context of a by summons application filed by the petitioner/applicant for set aside of a notice of appearance submitted by a lawyer on behalf of the respondent company due to lack of authorisation and invalid appointment, the Cypriot Court proceeded to set aside same and to order the lawyer to personally pay the legal costs of the procedure.
The Court in reaching its decision in this application, proceeded to adopt the recent English decision in Rushbrooke UK LTD v 4 Designs Concept Ltd [2022] EWHC 1110, and concluded that this was an appropriate case in which to apply the decision in Rushbrooke, because despite the fact that the applicant had brought from the start to the attention of this lawyer that his appointment on behalf of the Respondent Company was invalid and unauthorized, same, despite these warnings continued to represent the respondent company and incur costs on its behalf.
