CYPRUS: Enforcement of foreign judgment
The enforcement of foreign judgments in Cyprus can be effected, either under statute (i.e. provided there is a bilateral arrangement between the Republic of Cyprus and the country of issue of the specific foreign judgment regulating such enforcement) or under common law.
In the absence of any statutory jurisdiction of Cypriot Courts to recognise and enforce a foreign Court judgment in the Republic of Cyprus, then such a foreign judgment may be recognised and enforced by an action at common law (i.e. an action based on the foreign judgment).
When a foreign Court judgment may be registered and enforced under statute, then there is no jurisdiction of Cyprus Court to enforce such foreign judgment by an action at common law.
